Kids Theatre Works! Terms and Conditions

  1. INTRODUCTION

1.1.This section sets out the terms and conditions by which Kids Theatre Works! (KTW Creative Consultants) agrees to provide products and services to you and your child.
1.2 Terms and conditions will be added soon.

 

1.3 We reserve the right to modify, cancel or append to these Terms and Conditions.  On renewal of Sessions or purchase of any KTW product or service, the most recent Terms and Conditions shall apply.  These always appear on our website.
2. DEFINITIONS
2.1 Course refers to classes or workshops that take place at a specific time on the same day, in the same venue, each week during term time.
2.2  Holiday Workshop is a holiday course offering a combination of drama, dance, art and singing activities for certain amount of hours per day for a period of between one and five days.
2.3  Classes refers to general drama courses, including Child’s Play, Acting Up! And Dramarama.
2.4  Workshops refers to courses specialising in skills relating to performance.
2.5  Registration refers to filling out the blank online form with details relating to your child’s application to attend Kids Theatre Works! Courses.
2.6 Sign-Up refers to the act of selecting one of the courses your child wishes to attend via our website. 
2.7 Confirmation refers to your child’s sign-up process being finalised and a place in a booked course being granted upon receipt of full payment.
2.8 Session refers to a particular class or workshop held at a specific time on a specific date at a specific venue for a specific duration.
2.9 Missed Session is a booked session, which has not been attended by your child.
2.10 Booked Session/Course is a Session/Course that we have agreed that your child may attend, either verbally or in writing.
2.11 Term Time refers to the periods throughout the year during which we offer regular weekly courses as outlined on our website.
2.12 Waiting list is a list kept and maintained by KTW compromising children who wish to attend a session or course that is full.
2.13 Your child is any child for whom you are nominated as an authorised adult on the online Registration form regarding your dealings with KTW and we therefore deem to be in your care.
2.14 Venue refers to the location that  booked courses are being offered at.
2.15 KTW, We, Us or Our refer to Kids Theatre Works! (KTW Creative Consultants) and any of its Employees.
2.16 You refers to a person or organisation buying products or services from Us.
3. COURSES
3.1  Trial Period
3.1.1 Trial Period is defined as the first 3 consecutive sessions immediately following enrolment.
3.1.2 If within the Trial Period a written notification of a student wishing to discontinue a course is received, a refund for all unattended sessions of the course will be offered.
      3.1.3 After the Trial Period expires, no refund will be offered under any circumstance.
3.1.4 Written notification must be made by email to admin@kidstheatreworks.com or by hand written letter.  SMS text message notifications will not be considered satisfactory and refunds will not be prepared as a result of their receipt.
3.1.5 Refunds will be made available by cheque, within 14 days of receiving written notification. Details of whom to make out the refund cheque to must be included in the notification.  
 
3.2 Sign-Up
3.2.1  Booked Courses
3.2.1.1 You must book a full course at any one time. Courses will run on consecutive weeks during Term-time and may span short holidays.
3.2.1.2 Details of KTW Term Time Dates can be found on the website.  It is your responsibility to make yourself aware of these.
3.2.2 Payment
3.2.2.1 The cost of booked courses and valid methods of payment are given on the website.
3.2.2.2 The full cost of Booked courses minus any agreed discounts must be paid by the end of the first Booked Session of the course.
3.2.2.3 We reserve the right to offer discounts at our discretion.
3.2.2.4 A course is not considered booked until full payment for the course is received. 
3.2.2.5 If full payment is not received by the end of the first booked session, we reserve the right to suspend all further sessions.
3.2.2.6 If full payment for the course is not received by the end of the first booked session, we reserve the right to offer your child’s place to a student on the waiting list, if such exists.
3.3 Merchandise
3.3.1 All Merchandise must be paid for at the time of purchase.
3.3.2 Refunds will only be offered for merchandise in saleable conditions and where the cellophane wrapper is intact.
3.3.3 Merchandise that is defective will be replaced if returned within one week of purchase.
3.4 Switching
3.4.1 If you would like your child to switch to a class at a different time to their current class, you must notify us at least 3 days prior to your child’s intended first switched session.  This is subject to availability in the requested class.
3.4.2 Switching classes (transferring) between venues is currently not offered.
3.5 Missed Sessions
3.5.1 Sessions missed for any reason may not be added on to the end of the Booked Sessions under any circumstances.
3.5.2 If your child misses a booked Session, subject to availability, you may arrange a make-up session at another class in the same venue, if such is offered.
3.5.3 In order to avail of a Make up session, the parent must sign up for a Make Up session in the Members Area on www.kidstheatreworks.com. Access to the Members Area is granted upon use of your username and password to log in. Notification must be received by 10 am on the day prior to the requested class.  
3.5.4 Conditions for Missed Sessions currently apply only to classes and not workshops.
3.6  Waiting Lists
3.6.1 If your child is on a waiting list, this does not guarantee a place in a particular session or course.
3.6.2 We accept no responsibility or make no guarantees to the order to which places are offered.
3.7  Roles
3.7.1 While we endeavour to offer most children attending workshops a speaking or singing solo role, this is not always possible and bookings contain no guarantees to this effect.
4. HOLIDAY WORKSHOPS
4.1 Payment – Please refer to payment for courses in section 3.2.2 
Except:
4.1.1 If full payment is not received at the time of confirming the booking of the holiday workshop, we reserve the right to cancel the booking.
4.2 Missed Sessions
No refunds or Make-up sessions are available for Missed sessions during a holiday workshop under any circumstance.
5. EXCLUSIONS
5.1   In the event that we consider:-
5.1.1.  You are in breach of any of these Terms and Conditions
5.1.2.  The behaviour of your child is disruptive or likely to put other children or our staff in danger.
5.1.3.   Your behaviour towards KTW Staff, other customers, children in our care, employees at our venues is disruptive, inappropriate, consistently negligent (including late collection of your child) or likely to bring us or any of our services into disrepute, we reserve the right to exclude your child from any KTW activity or part thereof.
5.1.4.  In the event that your child is excluded from KTW courses and workshops, no refunds will be paid to you.
6. LIABILITIES
6.1 Cancellations and Venue Changes
6.1.1 We reserve the right to cancel any Sessions, courses or holiday workshops or any other service at any time up to and including the date the activity starts. Should this occur we will try to give you at least 7 days notice and will attempt to offer you a viable alternative or will offer you a refund of any fee paid.
6.1.2 Occasionally it is necessary to temporarily change the venue of a session, course or holiday workshop or any other activity.  In such a case, we will do our best to ensure that the alternative venue is within a short distance from the original venue.  If the distance is too great for your child to attend the alternative venue, we will offer a refund for the missed session.
6.2 Health and Injuries
6.2.1 We accept children on the assumption that they are in good health and it your responsibility to alert us to any medical complaint or history suffered by your child.
6.2.2 We do not accept responsibility for loss or damage arising from errors or omissions on the Online Registration form whether completed by you or by another person in charge of your child at the time of completion.
 6.2.3 We do not accept liability for death or personal injury to any child attending KTW or any activity related to KTW or otherwise.
6.3 PERSONAL PROPERTY
6.3.1  We do not accept responsibility for any loss of or damage to, personal property belonging to you or your child irrespective of whether such possessions might be used by you or the child for the purposes of any KTW activity  except in the case that the loss or damage is caused by the negligence of any of our staff.
6.4  Use of Personal Information
6.4.1  We may monitor and record communications with you for quality assurance, legal and training purposes.
6.4.2 From time to time, photographs, film, video or audio recordings may be made during KTW activities for publicity, promotional or broadcast purposes.  Please inform us before any such event if you do not wish you or your child to appear or be identified in any such material.
6.5  Contact
6.5.1 You may contact us by calling the hotline number found on our website or by sending an email to admin@kidstheatreworks.com; hello@kidstheatreworks.com; or to the Artistic Director emily@kidstheatreworks.com.
6.5.2 We may contact you by telephone, email or SMS text.  Notification sent to you by email or SMS text will be considered received by you within one working day.  
6.5.3  It is your responsibility to ensure that we have current contact details for you and all adults authorised to pick up your child.  You must also keep us updated of any changes in the health or other relevant circumstances of you or your child.
6.5.4 We may accept any instructions which are given to us regarding child from anyone who is nominated as an Authorised Adult on the online registration form for that child.

3. COURSES

3.4 Switching

3.4.1 If you would like your child to switch to a class at a different time to their current class, you must notify us at least 3 days prior to your child’s intended first switched session.  This is subject to availability in the requested class.
